Acceptance of Terms
By creating an account and using the Admin Panel of SKMD Sports LLC ("Company," "we," "us," or "our") to create a booking site or just use the Admin Panel functionalities, you, as the company owner, agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Admin Panel.
Account Registration
- Eligibility: You affirm that you are of legal age and are otherwise fully capable and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
- Account Security: You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
Use of the Admin Panel
- Permitted Uses: The Admin Panel is provided to manage your company’s engagement with SKMD Sports LLC services. Any other use not expressly permitted by these Terms is prohibited.
- Prohibited Conduct: You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Admin Panel in any medium; (ii) using any automated system, including "robots," "spiders," "offline readers," etc., to access the Admin Panel; (iii) transmitting spam or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Admin Panel.
Booking Site Creation
- Provision of Booking Site: The Admin Panel includes a feature allowing you to create a customized booking site ("Booking Site"). This site can be used to facilitate online bookings for your services directly through the SKMD Sports LLC platform.
- Customization and Content: You may customize your Booking Site within the guidelines provided in the Admin Panel. You are responsible for the accuracy, legality, and appropriateness of all content (text, images, and other media) uploaded or displayed on your Booking Site.
- Functionality: The functionality of the Booking Site includes but is not limited to scheduling, customer management, payment processing, and analytics. These functionalities are intended to enhance the interaction between you and your clients.
- Usage Compliance: You agree to use the Booking Site in compliance with all applicable laws and regulations and in a manner that does not infringe on the rights of others or interfere with the operation of the Booking Site or associated services.
- Service Availability: We strive to ensure the availability of the Booking Site but do not guarantee uninterrupted service. Scheduled maintenance, unforeseen downtime, and outages may occur and will be addressed promptly.
- Termination and Modification of Service: We reserve the right to modify, suspend, or discontinue the Booking Site feature at our discretion without notice. In the event of discontinuation, you will be notified and provided with alternatives or solutions to migrate your services.
- Data Handling: All client data collected through the Booking Site will be handled according to our Privacy Policy. You are also responsible for ensuring that client data is managed in compliance with applicable data protection laws.
- Fees: Additional fees may apply for the use of the Booking Site, which will be disclosed and agreed upon during the setup of this feature. These fees are subject to change, and any changes will be communicated as outlined in the Fees section of these Terms.
- Indemnification: You agree to indemnify and hold harmless SKMD Sports LLC against any claims arising from your use of the Booking Site, including but not limited to the violation of third-party rights and compliance with applicable laws.
Data and Privacy Policy
- Data Collection: We collect personal and company information necessary for account registration and service provision. This may include contact details, company information, and usage data.
- Use of Data: Data is used to manage account settings, provide customer support, improve our services, and communicate important information and updates.
- Data Protection: We implement robust security measures to protect your data from unauthorized access, alteration, disclosure, or destruction.
- Data Sharing: We do not sell, trade, or rent your personal identification information. We may share generic aggregated demographic information not linked to any personal identification information with business partners and advertisers.
- User Rights: Users have the right to access, correct, or delete their personal information stored with us.
- Cookies and Tracking: Our platform may use cookies and similar tracking technologies to enhance user experience.
Fees
- Subscription Fees: Fees for using the Admin Panel are based on the subscription plan selected. Details of these plans and their costs are available on our website.
- Payment Terms: Fees are due as per the selected subscription plan, they will either be collected at point of transaction or paid in advance if agreed upon through email confirmation.
- Refunds: All fees are non-refundable except as expressly provided in these Terms.
- Changes in Fees: We reserve the right to modify the subscription fees upon providing prior notice.
- Late Payments: Late payments may result in the suspension or termination of services.
Intellectual Property Rights
The Admin Panel and subsequently the booking site generated by it, including its original content, features, and functionality, are and will remain the exclusive property of SKMD Sports LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SKMD Sports LLC.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. We will provide at least 30 days' notice prior to any new terms taking effect.
Governing Law
These Terms shall be governed and construed in accordance with the laws of [Dubai, United Arab Emirates], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights
Dispute Resolution
In the event of a dispute arising from or relating to these Terms, we strongly encourage contacting us directly for a resolution. If the dispute is not resolved, it will be resolved through binding arbitration.
Limitation of Liability
To the maximum extent permitted by law, SKMD Sports LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Indemnification
You agree to defend, indemnify, and hold harmless SKMD Sports LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Admin Panel, or b) a breach of these Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Entire Agreement
These Terms constitute the entire agreement between us regarding our Admin Panel and supersede and replace any prior agreements we might have had between us regarding the Admin Panel.
Listing on Real Sports Club (https://www.realsports.club/) Marketplace
Marketplace Participation
Upon mutual agreement through email or written confirmation on Whatsapp, service providers who use the Admin Panel can opt to be listed on the Real Sports Club marketplace to enhance their visibility and reach to potential customers.
Marketplace Commission Fee
- A marketplace commission fee will be agreed upon in advance with each service provider. This fee is valid for a period of one year, subject to revision with at least 30 days' notice before any changes take effect.
- Delisting Right: Service providers have the right to be unlisted from the marketplace at their discretion, ensuring flexibility and control over their marketplace presence.

BY USING THE ADMIN PANEL, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND AGREE TO BE BOUND BY THEM.
